There is some things you need to know about Self Representation......
When comes to self representation is a justice of today it be quiet scary. It be downright disturbing as well. If you have the right tools and guidance to get the job done. Here is some pointers to get you started:
1. Never tell the other party that you are suing them. It makes things complicated in long run. You might lose that person or contact. It the courts job to make sure that the other party appears to court. Once paperwork is filed let the courts take care of the rest.
2. When filing for a case whatever the case is. Make sure speak to the file clerk(s) or someone with experience come with you in filing legal paperwork. Know the fees in filing and understand courts detail process in filing for a case. You be so relieved in knowing the court filing process works
3. Know who you are suing! No judge likes anyone not knowing the party they are suing. Please when filing do your research. Make sure you have research the case you filing and other party company, person, or payment made in which they themselves have done business with, did a service, or family related issues.
4. No judge likes a know it all. We have known people to be a know it all. Don't ever tell the judge what the law is!! Judges hates that. They can easily throw out the case immediately. Your voice will never be heard. Talk to the party that you are suing about the law before court. Both parties know there rights.
5. Always be careful in what you say and do. Once you have your court date the courts will be watching and sending someone to make sure to follow the rules. This if you are representing yourself: criminal, family, or traffic case. If you represent yourself in these know there is will be a target on you. Once you get wrap up anyone of these cases. You have make sure you are following the rules!!! Don't break the law after you just resolve this case. Even though, you can't be tried for same crime twice. If you are a repeated offender you will get in trouble faster. You also get heavier charges going against you. Family Law is bit messy. Remember this it not what best for you or the other party. It what best for the kids... What best for the person who more fit to parent than the other party.
6. Always if you don't remember nothing else!!!! KNOW YOUR RIGHTS!!!!! It better to be prepared not to be prepared at all....
Should you represent yourself in court? Possibly. If you are ready to be a pro se litigant you could represent yourself. And more and more people are doing so. Check out this video to learn the four reasons why people are representing themselves. My name is Barry with the LawFull channel. I’m a Chicago personal injury lawyer. Every week I publish a new short video on legal topics that affect your life. Are you thinking of creating your own will? Maybe you’re going through a divorce and you can’t afford a lawyer so you’re going to represent yourself. Or perhaps you were involved in an automobile collision and you want to pursue your claim against the insurance company on your own. You’re not alone. There has been a significant increase in the number of people representing themselves in all types of legal matters. When people represent themselves in court it’s called appearing “pro se”. There are a lot of resources on the web for pro se litigants like this website on the American Bar Association website: http://bit.ly/2hKhuje Here is a link on how the court system can help people who want to act as their own attorney: http://iaals.du.edu/ So why are more people representing themselves? I think it’s due to 4 reasons: Number 1 Reason – Money: Attorneys’ can be expensive. Your average person or your average small business may not be able to afford to pay $3or $400 per hour to hire an attorney. So, a lot of these people are trying to represent themselves. Number 2 reason - Lawyers Are Turning Cases Away: I receive calls from all over the place from people who were injured. Many of the calls are medical malpractice cases. But these cases are extremely expensive to litigate. So, medmal attorneys are only interested in signing up the best cases. The situation is similar regarding auto accidents. It is harder and harder to get money out of an insurance company for “soft-tissue” injuries such as sprains and strains. Insurance companies just aren’t paying anymore. And most not all but most lawyers are not going to file a lawsuit for these types of injuries as the cost of doing it is so high. So, many lawyers I talk to are turning away these types of cases, which results in victims having to fight the insurance company on their own. Number 3 Reason - The Internet: There’s so much information available on the internet. There are thousands of websites dedicated to providing legal information including: www.Findlaw.com, www.lawyers.com, www.avvo.com, www.nolo.com and of course YouTube. Number 4 Reason – It’s kind of a trend that’s happening in our society. I think people are somewhat fed up with all of our governmental systems, the courts included. And they are looking for alternatives.
